The 491 Regional Work Visa was introduced in November 2019 and is fast becoming the most favourable option to move to Australia especially given the current Covid 19 pandemic which has made migrating to Australia extremely competitive.
Firstly, it is important to understand the benefits of holding a 491 Regional Work Visa and we have summarised these below:
– 491 Visa holders get access to Australian government funded health care system “Medicare”, as such one would not have to purchase private health insurance

– Children (below 18 yrs of age) of 491 Visa holders are also entitled to study in government schools and are required to pay the same nominal amount as Australian Citizens or Australian Permanent Residents

– This visa also offers an easy pathway to permanent residence which requires a visa holder to live and work
in specified regional area for at least 3 years and then proceed with application of permanent residency
– The Australian Immigration is giving priority for processing 491 Regional Work Visa over permanent visas and will reduce the time frame for processing these visas as it wants more migrants to move to regional areas which will help in regional economic development and ease the pressure on metropolitan cities in terms of resource management and congestion.
The latest update from NSW government stipulates that is awaiting further allocation of places from Home Affairs for the remainder of financial year.
NSW government has formed a new arrangement where it will be giving responsibility to Regional Development Offices (RDA) to set up their own eligible skilled occupations for nomination and for accepting and assessing nomination applications.
Nomination criteria for 491 visa in NSW will remain consistent across all regions within the state.
Applicants must meet any one of the following criteria to be eligible for NSW state nomination.
Criteria 1: Applicants Living and Working Outside of NSW
a) If you are living and working outside of Australia then, you must:
– Hold a valid skills assessment for an occupation that appears on nominated regions occupation list

– Have at least 5 years of skilled full-time work experience in your nominated region’s occupation
or
b) If you are living in Australian but not living in regional NSW then, you must:
– Have job offer in regional NSW
– Hold valid skills assessment in your nominated region’s occupation
– Have an offer of ongoing employment that is in regional NSW in applicant’s nominated occupation for a minimum term of 12 months and 35 hours/week
– The employer must be in designated regional area in NSW and must be registered in Australia
or
c) If you have family ties in NSW then, you must:
– Hold a valid skills assessment for an occupation that is listed on nominated region’s occupation list
– Have an immediate family member who is at least 18 years of age and is an Australian Citizen or Permanent Resident or NSW nominated 489 visa holders who happens to reside in a designated regional area in NSW and

– The relative can be step or adopted or blood related brother, sister, father, mother, grandfather or grandmother.
Criteria 2: Applicants Living and Working in Regional NSW must:
– Hold a valid skills assessment for a nominated occupation that is on region’s occupation list

– Have been living and working in designated NSW regional area for at least last 12 months and
Criteria 3: Applicants who have recently completed their study in Regional NSW
– Applicants must hold valid skills assessment for nominated regions occupation list

– Have completed studies while living in designated regional area and the studies were relevant to the nominated occupation and were completed with an education provider (located in designated regional area) within the last 24 months

In the process of skills assessment, an assessment of an applicant’s work experience and qualifications is carried out by relevant assessing authorities.
