State Nominations Available For Australian 491 Visa – Part I

Since the commencement of the Skilled Work Regional 491 visa as off the 16th November 2020, it has become      a highly sought-after visa type that when granted offers a pathway to Australian Permanent Residency and has less restrictions and is not employer dependent as compared to a 482 Work Visa.

There are essentially two streams of this visa:

a)       State Sponsored Stream
b)      Family Sponsored Stream

State Sponsored Stream 491 Visa is currently the most popular one and the least competitive in terms of its requirements.

If an applicant has an occupation that is listed on any of the State Occupation lists and the applicant is able to procure 65 points on the points tested stream for Age, English (minimum of competent level), Work experience and Educational qualifications then, one may be eligible to apply for the 491 visa.
Some States have other sub streams such as those for small business owners, graduates from Australian Universities. These sub streams can also be utilised by visa applicants to lodge their 491 Visa application.

Tasmania

Many applicants tend to overlook this island state however, it has some of the most generous criteria for State Nomination Applications.

It also has more different types of sub streams available under State Nomination program as compared to any of the other Australian States.

For offshore applicants their nominated occupation must be listed on the Tasmanian Skilled Occupation List and they should not have lived in another Australian State or Territory within the last 12 months. Applicants are also required to show that there are sufficient employment opportunities available in the job market (this can be done by way of researching job ads and proving that applicant meets the skills and qualification requirements for the available vacancies).

Should an offshore applicant receive a job offer from an employer that is established and has a genuine need for the position then they do not have to show availability of job opportunities in the employment market.

Onshore applicants must have been living and working in Tasmania for at least six months before they can lodge an application. They must also be employed by an established business which has a genuine need for the position.

Tasmanian Graduates who have completed full time studies of trade qualification, diploma, a Bachelor degree or higher and have lived in Tasmania for at least 1 year during their period of study are also eligible to apply for a State Nomination.

Foreign nationals who are small business owners and who have established their business in Tasmania and have been running it for at least 6 months  and it is likely that the business will generate an income of $53,900 might also be eligible to apply for a State Nomination.

Lastly, applicants who have immediate family members who are Australian Citizens or Permanent Residents who have resided in Tasmania for a minimum of 12 months 

South Australia

South Australia has many occupations available for State Nomination.

Offshore applicants currently have access to over 274 occupations for State Nomination. In our experience should South Australia receive a large number of applications for a particular occupation then, that specific occupation is moved under a supplementary list with higher threshold requirements.

Onshore applicants must be able to prove that they have lived and worked in South Australia for the last 6
months before their application is lodged.

South Australian State Nomination program is also available for South Australian International Graduates, it
requires the applicant to reside in South Australia for at least one year during which they must complete a qualification that has a minimum duration of 46 weeks.

ACT (Australian Capital Territory)

The Australian Capital Territory utilizes its own points matrix to select applicants for nomination.

For offshore applicants to receive a State nomination, they must not have lived in any other Australian State or territory within the last 12 months. They must also have at least 12 months of continuous experience within last three years in their nominated occupation and should also be able to demonstrate employability in Canberra.

Applicants who are currently onshore and reside in Canberra must have been living in Canberra for at least three months before lodging an application and they must also be working for an ACT based employer in Canberra for at least three months.

Considering that ACT is a smaller territory, there are less number of available occupations for nomination on its Occupation List.
